This book considers the way that Cesare Beccaria's slim 1764 volume On Crimes and Punishments influenced policy developments worldwide and over decades, if not centuries, after its publication. For those who turn to Beccaria's work today, the encounter is shaped by that knowledge. Appreciative of his book's dual nature as historical document and repository of ideas, the contributions in this collection address different aspects of the criminal justice theory Beccaria offered his readers and face up to methodological questions raised by (...) meeting a historical text of this kind - unsystematic and by modern standards often under-argued - with modern scholarly conventions in mind. Contributions in the first part of the book engage with Beccaria's 'political theory of criminal justice' through the lenses of political and penal philosophy. Qualitative research is marked by context sensitivity with an inclusion of the participants’ points of view and setting, how they can affect how participants feel and how this feeling is captured and interpreted by researchers. This is the value of exploring affective variables through qualitative research. The present study focuses on the qualitative studies of L2 affective variables in recent years led by the complexity dynamic systems theory. This new line of research has employed innovative research methods compatible with the (...) CDST, and has had useful findings. Yet, they seem to lack rigor and systematicity of research. Thus, this observed lack of consistency is problematized in the present study and attempts are made to set evaluative criteria for the judgment of the burgeoning studies and guiding the future line of qualitative and dynamic inquiry in the L2 affective domain. To this aim, the different sets of evaluative criteria proposed for qualitative research are derived from the mostly cited scholars in the research methodology. The relevance of each to the dynamic qualitative investigations of L2 affective variables is discussed. Then these evaluative criteria are abstracted and put forth for the qualitative research in the dynamic phase of second language acquisition research. The overall goal is to guide future researchers with an interest in investigating the dynamic and developmental nature of L2 affective variables qualitatively. These evaluative criteria can pave the way for the emergence of more rigorous and systematic qualitative studies of L2 affective factors in the future. (shrink)

This study examines the representations of human gene patents in Chinese newspapers. We conducted a qualitative content analysis of news articles published between 2006 and 2017 to identify the major themes in media coverage, ethical considerations, perceptions of risks and benefits, and attitudes towards the patentability of human genes. The results show that two key ethical concerns were expressed by journalists: that it is morally wrong to own or patent human genes and that gene patents could potentially impede patients’ access (...) to healthcare services. Nonetheless, the press coverage has tended to be largely favorable, rather than opposed to human gene patenting. There were no normative claims that human genes should not be patentable in China, which indicates a generally positive attitude towards patentability in media discourse. Most articles that expressed criticism toward gene patenting discussed challenges in other countries, with significant attention given to the United States Supreme Court’s ruling in the Myriad case that invalidated Myriad Genetics’ patents on the BRCA1 and BRCA2 genes. Overall, the newspapers were uncritical of the Chinese gene patenting regime. News reporting on the issue was highly suggestive of a strong pro-commercialization stance, although some discussions emphasized potential risks over benefits. Our analysis highlights the need for balanced media reporting on human gene patents in China and a top-down approach to engage the public in substantive discussions on the ethical and societal implications of the existing patent regime. Online crowdsourcing platforms have rapidly become a popular source of data collection. Despite the various advantages these platforms offer, there are substantial concerns regarding not only data validity issues, but also the ethical, societal, and global ramifications arising from the prevalent use of online crowdsourcing platforms. This paper seeks to expand the dialogue by examining both the “internal” aspects of crowdsourcing research practices, such as data quality issues, reporting transparency, and fair compensation, and the “external” aspects, in terms of how (...) the widespread use of crowdsourcing data collection shapes the nature of scientific communities and our society in general. Online participants in research studies are informal workers who provide labor in exchange for remuneration. The paper thus highlights the need for researchers to consider the markedly different political, economic, and socio-cultural characteristics of the Global North and the Global South when undertaking crowdsourcing research involving an international sample; such consideration is crucial for both increasing research validity and mitigating societal inequities. We encourage researchers to scrutinize the value systems underlying this popular data collection research method and its associated ethical, societal, and global ramifications, as well as provide a set of recommendations regarding the use of crowdsourcing platforms. This article explores the potential utility of certain features of Friedrich Nietzsche’s philosophical concepts for philosophical counselling. Central to the philosophical counseling process is philosophical counsellors applying the ideas of philosophers or philosophical system to inspire, educate, and guide their counselees in dealing with life problems. For example, the philosophical practice methodology of Logic-based Therapy, developed by American philosopher Elliot Cohen, provides a rational framework for confronting problems of living, where the counselor helps the counselee find an uplifting philosophy that (...) promotes a guiding virtue to act as an antidote to unrealistic and often self-defeating conclusions derived from irrational premises. I present the argument that Nietzsche’s analysis of suffering, is one such uplifting philosophy which can be of utility to philosophical counselors. According to Bernard Reginster, suffering forms the bedrock of Nietzsche’s life-affirming concept of the ‘will to power.’ Nietzsche’s notion of the will to power radically alters our conception of, and the significance we assign to suffering, where the will to power is best understood as an individual’s desire for the activity of overcoming resistance. Nietzsche’s analysis implies that the fundamental human impulse is not to avoid suffering, but rather to embrace suffering as an unavoidable existential given of life itself: the meaning to be found in suffering is tantamount to affirming life itself. Using the original information from the identification cards of CEOs and signing auditors to hand-collect the data on CEO–auditor dialect connectedness (_CADC_), we examine the effect of _CADC_ on audit opinion shopping (_AOS_), and further investigate the moderating effect of auditor reputation. Using a sample of Chinese listed firms during the period of 2007–2019, our findings reveal that the likelihood of _AOS_ is significantly higher for firms with _CADC_ than for their counterparts. This finding suggests that _CADC_ impairs auditor independence (...) and triggers _AOS_. Moreover, the effect of _CADC_ on _AOS_ is less pronounced for _BIG10_-audited firms than for non-_BIG10_-audited firms, implying that auditor reputation attenuates the relation between _CADC_ and _AOS_. Furthermore, the above findings are robust to alternative proxies for _CADC_ and _AOS_, and our conclusions are still valid after using the Heckman two-stage regressions, the propensity score matching approach, the change model method and the regression discontinuity design to control for the endogeneity issue. Lastly, the impact of _CADC_ on _AOS_ stands only for engagement auditors, but not for review auditors. Overall, our study enriches the existing literature on _AOS_ and auditor independence. A moving cultural biography of abolitionist martyr John Brown, by one of the most important African-American intellectuals of the twentieth century. In the history of slavery and its legacy, John Brown looms large as a hero whose deeds partly precipitated the Civil War. As Frederick Douglass wrote: "When John Brown stretched forth his arm... the clash of arms was at hand." DuBois's biography brings Brown stirringly to life and is a neglected classic.

Online discussion forums are an essential and standard setup in online courses to facilitate interactions among learners. However, learners’ inadequate participation in online discussion forums is a long-standing challenge, which necessitates instructor intervention and the design consideration of online learning platforms. This research proposes and studies the role of mandatory participation, i.e., learners’ participation in online course forums by instructors’ requirements, in fostering their voluntary participation and boosting their learning performance. This novel effect link between mandatory participation and voluntary participation (...) has not been assessed in previous research. An empirical study is conducted using a large-scale dataset of 27,767 learners from a leading massive open online course platform in China. The findings indicate that besides its direct effect on learning performance, learners’ mandatory participation has a significant positive effect on their voluntary participation in online course forums, enhancing learning performance. Moreover, the effect of mandatory participation on voluntary participation varies across learner groups, being more prominent for early registrants than late registrants and part-time learners than full-time learners. This research contributes to the online learning literature by introducing mandatory participation as a viable approach to foster voluntary participation and boost learning performance through enhanced voluntary participation. It provides evidence on the effectiveness of the novel design feature of MOOC platforms that enables and facilitates the mandatory participation mechanism in online learning. (shrink)

Relational integration is essential for learning, working, and living, as we must encode enormous volumes of information and extract their relations to construct knowledge about the environment. Recent research hints that generating distant analogies can temporarily facilitate learners’ state-based relational integration. This study aimed to investigate the internal mechanism underlying the facilitation effect and preliminarily confirm its application in education. First, we adopted the classical n-term premise integration task and the Latin Square Task to explore the robustness of the facilitation (...) effect. Then we employed an emerging multidimensional relational reasoning task to further explore the internal mechanism underlying this facilitation effect. Finally, we verified the practical role of the facilitation effect in learning the interaction concept in statistics. The results showed that generating distant analogies did facilitate students’ relational integration performance, both in classical cognitive tasks and in a practical learning task, and a relational mindset and cognitive load play an intermediary role in the facilitation, supporting the cognitive load theory. The results suggest that generating distant analogies can be a useful warm-up activity to assist educators in promoting students’ relational integration. (shrink)

Due to the advent of deglobalization and regional integration, this article aims to adopt LASSO-based network connectedness to estimate the multiscale tail risk spillover effects of global stock markets. The results show that tail risk varies across frequencies and shocks. In static analysis, the risk is centered mostly on the developed European and North American markets at a low frequency, and regionalization is imposed on the moderate frequency. Moreover, emerging markets could be sources of risk spillover, especially at the highest (...) frequency where there is no absolute risk center. In dynamic analysis, we use rolling window estimation and find that different frequencies identify distinct episodes of shocks, which provides us with the reason for the diverse risk centers at different time scales in static analysis. Our findings provide heterogeneous financial practitioners, regulators, and investors with diverse characteristics of stock markets under multiple time horizons and help them operate their own trading strategies. The parables of Jesus have historically been attributed with a plethora of interpretations. The first hearers of the parables of Jesus had native (emic) knowledge of the social realities embedded in the parables told by Jesus, that is, cultural scripts present in the parables that might not be apparent to modern readers. Because of this, the modern reader of a parable might not be aware of all the different cultural scripts in a given parable, especially if these scripts are not (...) specifically mentioned or explained by the gospel narrators. Using the parable of the Prodigal Son as an example, this study argues that there are voices in the parable most probably heard by its first hearers that modern hearers might not be aware of. These ‘muted’ voices not heard by modern readers of the parables often include the voices of women and other minority figures. In this study, a case is made for the possible value that a ‘realistic reading’ of familial parables could bring to the interpretation of the parables.Contribution: It is suggested that this reading can contribute to feminist biblical scholarship’s deconstruction and reconstruction of gender paradigms of Christian theology if the voices of women are ‘exhumed’ from or ‘unhidden’ within, patriarchal and androcentric texts.
